The Associated Press reports the Miami Heat star asked a Chicago judge to suspend Funches-Wade’s right to visitation with their two sons, Zaire (10) and Zion (5), after a weekend incident that delayed the boys’ return to Wade’s care.
The emergency motion was filed Tuesday with the hearing set for June 26– the same date of Game 7 (if necessary) between the Heat and Oklahoma City Thunder.
Funches-Wade was reportedly charged with two counts of attempted child abduction, two counts of unlawful visitation interference and one count of resisting arrest.
Wade says his sons were with him in Miami by 6 a.m. on Sunday, Father’s Day.
“Once again, S.L. has used our minor children as the proverbial pawns in this contentious dissolution of marriage action,” Wade wrote about Funches-Wade in the filing. “This court must take action to protect our minor children from further exposure to the present environment S.L. creates while they are in her care and preventing S.L. from exercising her parenting time in a manner that is harmful to our children. [...] The minor children have been subjected to great deal of drama/trauma as a result of S.L.’s conduct.”
Funches-Wade will be due back in court in August.
After divorcing in 2010, Wade was granted sole custody of the couple’s children in March 2011.
The NBA champion, who is currently dating actress Gabrielle Union, is set to debut his book A Father First: How My Life Became Bigger Than Basketball in September.
